"I would have to agree with Philippe here. We all see the different form factors (and similarities) between them. Instead of defending your design in this commenting area, it's better to make a case as part of your project. "
"Having little knowledge about patent law, I couldn't believe "first to file" would work as it might sound like. Does this mean we can file a patent for wheel? or gears? or spoons, chopsticks...? There must be some kind of interpretation on the boundaries of this rule. "
"First of all, I agree with one of the readers: this has little to do with Aliexpress. Legal action against Alibaba probably will not take you anywhere. But that doesn't mean Baker cannot use them as his leverage. Here are my suggestions: 1. Buy one if you can. Make a video, take more photos or whatever. After all, someone has already realized your design quite truthfully to your original drawing, why not use it to serve you better :)2. Contact Alibaba to ask them take the product off their list. 3. Find a friend who speaks Chinese or fellow Chinese design student to help you contact the seller directly. If you managed to get in touch with them, and if you really want to take this as an opportunity as opposed to adversity, buy a flight ticket and show up at their door. Try to find out what exactly happened and see if you can negotiate something out of this (At least theoretically you could block this product from getting into major US retail channels. Take this as a leverage). All too often the truth is much more than a bunch of greedy evil people like to stealing or knocking things off. I may sound like I've been reading too much fictions. But life is full of surprises. Be positive. :)"
